Further proof that Sony doesn't have a trademark in Europe for PSP?

As independent retailers across the UK continue to defy Cease and Desist orders issued by Sony Computer Entertainment Europe over the sale of import PSP consoles, the Japanese giant has begun court proceedings.

GamesIndustry.biz has obtained a copy of the legal document put together by Sony's lawyers, which refers to the trade marks 'PS', 'PLAYSTATION' and the controller symbols.

The document alleges that: "The defendant has infringed each of the claimant's said trade marks by using, without the consent of the claimants, in the course of trade in the United Kingdom, signs identical to the said trade marks."

"By reason of the aforesaid, the claimants have suffered loss and damage."

The document goes on to request an inquiry into damages payable and the confiscation of goods and materials. It also demands the names and addresses of both those who supplied the stock and those who purchased PSPs from the retailer.

In addition, Sony has informed retailers that its lawyers are preparing an application for an interim injunction to stop the sale of import PSPs in the run-up to the console's European launch, scheduled for September 1. It has offered to cancel the application if retailers agree to cease trading.

I dont feel sorry for those little bastards at all.. I hope Sony pin them. I know of a couple of importers here that arent just importing but are retailing bigtime.. huge adds.. and "you can only get the PSP from us" type advertising.. this is plain wrong.

Well I'm one of the lucky or not so lucky UK residents that purchased a Jap PSP Value Pack from a UK based online retailer. I feel Sony have every right to take these actions but I don't think it's going to solve the problem. If I hadn't bought my PSP from a UK based online retailer I would have definately bought one from abroad from someone like Lik Sang. I would be quite within my rights to do so as a consumer and Sony can't touch Lik Sang because they aren't UK based. What I'm trying to say is I think the majority of UK PSP owners would have done the same thing, I think the vast majority will have purchased their PSP's online & therefore would know there are plenty of online retailers willing to ship PSP's to the UK at very reasonable prices.

I'm beginning to think Sony are just a bunch of wan*ers.

You can't create a demand for a product on this scale, then deny people in a major geographical area from purchasing it.

If you look at the Play Asia page here you'll see that they are not importing to the UK.

The majority of this planet subscribed to the democratic/capitalist model - if Sony want to operate within that model, they should accept the fact that if they create a sought after item - people will seek it out, and try to own it.

Ablufia: The problem is not importing.. and people wanting to buy them.. its other companies _selling_ them.. its a subtle but huge difference. If you had a product that you were _preparing_ to sell in a particular country.. and you had other retailers (not involved with the retail chain you have had setup) .. putting out advertisements.. and such representing your product.. and your company.. without _your_ consent.. I think youd be a little pissed too. The small importers arent the problem.. its the ones that are taking advantage of the situation in two ways - selling a product without the owners consent (read _selling_).. and taking stock from Sony that they are trying to build up to have a launch in UK/Europe. .. these companies are also bypassing the retailer in the Sony retail chain as well who _have_ to wait because of their commitments to their supplier?
If you like the democratic and capialistic society that we live in, then what you are wanting is a communistic society, where everyone gets everything.. and companies have little or no ownership of their products and IP.. sorry.. I hope Sony slap these sods.. they have every right to.
